General Terms and Conditions (GTC)
1. Subject matter and scope of the contract
These General Terms and Conditions (GTC) apply to all mutual claims arising from and in connection with a contract between Nuuro AG and you, related to the Nuuro platform and the associated app, in their version valid at the time of your order.

Nuuro AG does not acknowledge any terms and conditions that deviate from these GTC unless expressly agreed to in written form.

Nuuro AG operates an app where you can purchase over-the-counter non-prescription medical self-tests, test kits, and health products. Nuuro also offers both Freemium and Premium versions, providing additional features and services. The services include the development, marketing, and distribution of health-related products and services. You can apply the purchased products at home for self-testing. Additionally, Nuuro provides recommendations based on your profile and home test kit results. Nuuro utilizes OpenAI technology to assist in generating part of its content and recommendations. This includes dietary recommendations and general tips for enhancing your overall well-being.

The app is available in the Google Play Store and the Apple App Store. Downloading the app requires prior registration with the respective app provider. The terms and conditions and privacy policies of the app store providers apply.

For the purpose of analyzing and evaluating the products you have purchased and the self-tests you have conducted, as well as for providing the results and the aforementioned information in your user account, it is necessary for the respective laboratories Nuuro collaborates with for the relevant product, to share the data generated during this analysis with Nuuro. Both the laboratories and Nuuro will collect and process this data. However, for the laboratories, the data will always and exclusively be linked to your Online ID and will not allow any inference to your personal data or identity. Nuuro will contractually obligate the relevant laboratories to collect and process all data in strict compliance with applicable laws and regulations, including data protection laws.

By using our service, you acknowledge that Nuuro utilizes the OpenAI API. As a result, you also agree to adhere to OpenAI's Terms of Use and Privacy Policy. Any interaction with or through our platform implies your acceptance of these third-party terms.

2. Registration and newsletter
You can create a user account through the Nuuro app by registering with at least an email address and a password of your choice. Other options to sign in may be also available over time, such as with a phone number, Apple login and Google login. The user account is necessary to access the results of the analysis and evaluation, as well as the additional information and recommendations provided by Nuuro.

Upon registration, Nuuro will send you a confirmation email and set up a user account for you, where you can manage and update your personal data.

3. Conclusion of the contract, contract modification
Nuuro offers various over-the-counter medical self-tests, test kits, and health products for purchase at regular prices, as well as bundles at discounted prices. Nuuro also offers subscription and membership models for regular delivery of a fixed number of self-tests over a specified period of time.
Nuuro reserves the right to accept or decline your offer at its discretion. You have no entitlement to the acceptance of your offer and the conclusion of the contract. Nuuro makes no specific guarantees that the products and services offered on the Nuuro website and app are available, deliverable, or accessible in every country.

The contract language for all users of the Nuuro website and app is currently English. Additional languages will be added over time.

4. Right of withdrawal and return costs
A consumer is defined as any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. The provisions in this section apply to you if you meet this definition.

You have the right to withdraw from this contract within 30 days without giving any reason. To exercise this right, a clearly written statement (e.g. a letter sent by post or email) needs to be sent to Nuuro AG, c/o Impact Hub Zürich AG, Sihlquai 131, 8005 Zürich, Switzerland or info@nuuro.com.

The right of withdrawal does not apply to contracts for the delivery of perishable goods or sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery.

5. Warranty
Statutory warranty rights apply. As a consumer, you are advised to promptly check the delivered items for completeness, visible defects, and transport damage, and to notify us and the shipping company as soon as possible. Failure to do so will not affect your statutory warranty rights.

6. Prices, payment terms, and retention of title
The prices listed on the Nuuro app are prices, inclusive of applicable VAT. Import duties and taxes may apply for deliveries to certain countries. For subscriptions, Nuuro AG reserves the right to adjust the price after a minimum term. Customers will be notified in advance and given the option to object and cancel. In case of objection, Nuuro AG has the right to terminate the subscription for good cause. The total purchase price will be displayed before the final step of the purchasing process.

The delivered goods remain the property of Nuuro AG until fully paid for.

7. Delivery and shipping costs
Unless otherwise agreed, the goods will be shipped to the address you provide. Nuuro AG determines the shipping method. Nuuro AG is entitled to make partial deliveries. In the case of customer-requested partial deliveries, shipping costs will be charged for each partial delivery.

8. Contract duration and termination
The contract for setting up and using the user account runs indefinitely. You can terminate the contract at any time by sending a written notice to Nuuro AG, c/o Impact Hub Zürich AG, Sihlquai 131, 8005 Zürich, Switzerland or info@nuuro.com.

Terminating your user account does not include unsubscribing from Nuuro newsletters or other updates you may have signed up for. If you no longer wish to receive the newsletter, you can unsubscribe at any time by clicking the relevant link included in every newsletter.

9. Liability
Nuuro does not offer medical treatment or medical advice through its website or app. The information and recommendations provided are not a substitute for professional medical advice. They are intended solely as general guidelines to help you improve your overall health and well-being based on the results of self-tests you have conducted, as well as the information you added yourself in your profile. These guidelines are not designed or suitable for diagnosing, treating, or preventing any diseases. Nuuro's digital services do not constitute professional nutritional counseling either. Any nutritional advice is provided as a separate service, independent of other services offered. The service descriptions and all other information on Nuuro's domains and in the app are binding. Where applicable, these General Terms and Conditions also apply.

10. Miscellaneous
Nuuro reserves the right to change these General Terms and Conditions for future transactions. You will be notified by email about any such changes. If you do not object to these changes in written form within six weeks from the date of receiving the notification, they are considered accepted. Nuuro will explicitly inform you about your right to object and the consequences of non-responding at the time of notification.
